The following Terms and Conditions apply by the mere use of or access to Sello Editorial Onca Vega (hereinafter, indistinctly, the Platform), and we will therefore understand that you accept them and agree to comply with them.
If you disagree with these Terms and Conditions, you must refrain from accessing or using the Platform.
Onca Vega (hereinafter, indistinctly, the Provider) reserves the right to modify the content of the Platform, as well as these Terms and Conditions, at any time and without prior notice — see the "Changes" section below for the exact procedure.
Sello Editorial Onca Vega is a platform operated by Onca Vega to give visibility to books published under the imprint and to books by independent authors who are part of the community, and to connect writers with readers and with editorial services.
Accessing or using the Platform expresses the User's full adherence to these Terms and Conditions. The Provider has the right to deny, restrict, or condition the User's access to the Platform, in whole or in part, at its sole discretion.
The User acknowledges that not all services and content on the Platform are available to just anyone: publishing under the imprint and certain author features require a prior invitation (see the Accounts section). The Provider does not guarantee the uninterrupted availability or continuity of the Platform.
The User is not entitled to use the links, content, or features of the Platform on their own or third-party sites without the Provider's prior written authorization.
The User may not prevent any other User from using the Platform, nor interfere with its operation through devices, software, or any other means.
The User agrees to use the Platform in a manner that does not contravene good customs, the rights of third parties, standards of use and coexistence on the internet, or the laws of the United Mexican States.
There is no open public sign-up on Sello Editorial Onca Vega: every account originates from an invitation sent by our team, either because a book is part of the imprint or because an independent author's work was accepted into the community.
Access to the Platform is managed through SuperTokens, a third-party authentication provider. The User can sign in with email and password, or through their Google account (third-party sign-in).
By creating an account, the User declares, under penalty of perjury, that they are at least 18 years old or the age of legal majority in their jurisdiction, and acknowledges that it is their sole responsibility to keep their access credentials secret, as well as all activity that occurs under their account. If the User suspects unauthorized use of their account, they must notify the Provider immediately.
The Provider reserves the right to suspend or cancel an account when there is a breach of these Terms and Conditions, without this generating any liability on the part of the Provider.
The texts, covers, biographies, excerpts, images, and other materials that an author publishes on the Platform belong to that author and are protected under the Federal Copyright Law and other applicable intellectual property legislation.
Publishing a work on the Platform, whether under the imprint or as part of the community, does not transfer its ownership to the Provider at any point — the author retains all of their rights. The Provider's use of the content (displaying it in the catalog, on the book's or author's public page, in Platform promotional materials) is limited to what is necessary to operate the service for which the author submitted their work.
The Platform's design, source code, brand, logos, and other proprietary elements are the exclusive property of Onca Vega and may not be reproduced, distributed, or used without prior written authorization.
The User agrees that the provisions set out in the previous section regarding ownership of rights also apply to the rights of third parties — other authors, publishers, or rights holders — regarding any content presented or linked on the Platform.
The Provider offers the Platform's services with a reasonable level of skill and diligence from a commercial standpoint; however, the Platform is provided as-is and as available, without any warranty of any kind, express or implied, regarding its uninterrupted or error-free operation.
The Provider will not be liable for any damage or loss arising from the unavailability or discontinuity of the Platform, nor from inaccuracies, typographical errors, or changes periodically made to its content and features.
The User understands and accepts that use of the Platform is at their own risk, and that the Provider's liability, in all cases, will be limited to what is provided for under applicable law.
Some purchase links shown next to books published under the imprint (for example, to Amazon in the United States or Spain, or to Buscalibre) are part of affiliate programs the Provider participates in.
If the User purchases a copy through those links, the Provider may earn a commission from the corresponding retailer. This commission represents no additional cost to either the purchasing User or the book's author: the price paid is the same as would be paid by going directly to that store, without going through the Platform's link.
Revenue obtained through the affiliate program is used to maintain and provide technical support for the Platform. The affiliate identifier is added only when presenting the purchase link to the public (it is not stored in the database alongside the original URL the author provided), and it applies exclusively to book purchase links — never to an author's or user's contact or social media links.
Before being saved, every purchase link entered by an author or by the editorial team goes through an automated check confirming it points to a safe destination (HTTPS protocol, no excessive or suspicious redirect chains). This check protects both the author sharing the link and the reader clicking it.
The fact that information is shown on the Platform, or on sites linked to it (book stores, authors' social media, verification services like reCAPTCHA), does not imply a recommendation, warranty, sponsorship, or endorsement by the Provider of such information, goods, or services.
The Provider does not control the content or practices of those external sites and is not responsible for them. The User acknowledges that leaving the Platform for an external site is their own decision, subject to that site's terms and policies.
The Provider uses Google's reCAPTCHA Enterprise on some forms to prevent spam and automated misuse, and Cloudinary to host and optimize the images (book covers, profile avatars) the User uploads to the Platform themselves.
The Provider agrees to keep confidential any information received from the User that has that character under applicable legislation in the United Mexican States. The Provider assumes no confidentiality obligation regarding any information the User chooses to make public on the Platform (for example, their author profile or a book's public page).
A User who accesses the Platform agrees to receive files transmitted by the Provider's servers and those of its providers. Sello Editorial Onca Vega uses exclusively technical cookies necessary for its operation — a session cookie that keeps the User signed in, and a language-preference cookie — with no advertising cookies or third-party marketing trackers.
The User can change their browser's cookie settings at any time. If they choose to block them, certain Platform features, including signing in, may not work correctly.
The processing of the User's personal data is governed by our Privacy Notice, an independent document that forms part of these Terms and Conditions by reference. We invite you to read it before creating an account or publishing content on the Platform.
The Provider reserves the right to modify these Terms and Conditions at any time, without prior notice or the User's express consent. Any material change will be reflected on this same page, updating the version date noted at the top of the document.
The User must read these Terms and Conditions each time they use the Platform. Continuing to use the Platform after an update means accepting the modified terms.
For the interpretation, performance, and enforcement of these Terms and Conditions, the User agrees that the federal laws of the United Mexican States will apply, with the courts of the State of Mexico having jurisdiction, expressly waiving any other venue that might otherwise apply due to present or future domicile.
The User may contact the Provider at any time for any clarification, comment, or question related to these Terms and Conditions, through the Platform's contact form or the email listed on our official social media.
